  • Offers in writing for the properties can be made for purchasing at a private sale in accordance with article 3:268 paragraph 2 of the Civil Code. Such offers can be made to the aforementioned civil law notary up to and including January 11th, 2012. Any offer not accepted before January 18th, 2012, is deemed to be declined.
  • The auction will take place by raising bids (in Dutch: “bij opbod”) and by decreasing bids (in Dutch: “bij afmijning”), in one session. Seller has the right to not accept any bid, at his sole discretion.
  • All Auction Costs are for the account of the Buyer, which costs include: Transfer Tax (4% of the purchase price on Sint Maarten and 5% on Saba and Sint Eustatius), the Registration Fees (Kadaster), the outstanding Long Lease Ground Rent (erfpachtscanon), if any, the outstanding dues to the Association of Apartment Owners, if any, fees for execution of the necessary notarial deeds, other auction costs (rent of auction room, marshal fees, cancellation of liens and mortgages, advertisements), and the costs to have the property vacated, if necessary.
  • The successful bidder must submit a bank-guarantee issued by a reputable bank in Sint Maarten to the amount of the highest bid augmented by the charges for the account of the buyer
